This seminar will explore some technical, legal and commercial
aspects of pharmaceutical patents and patent litigation,
including examples from selected patent cases. The seminar
will be of specific relevance both to researchers in the chemical
and biotechnology disciplines, particularly those wishing to know
more about the role of patents in the pharmaceutical field, and
legal professionals wishing to know more about the commercial
context underlying patent litigation.
Joel Bernstein is an Institute of Advanced Studies
(UWA) 2010 Professor-at-Large and a noted chemist,
particularly in the fields of crystallography and solid
state chemistry. For more than 20 years he has
been involved as a scientific consultant or expert
witness in a number of patent issues and litigations
involving major pharmaceutical manufacturers and
products.
Todd Shand is a patent attorney and partner at
Wrays, a Perth-based firm specialising in intellectual
property, where he is one of 10 professional staff in
the Chemistry and Biotechnology Group. Todd joined
Wrays in 1997, having completed studies in chemistry
(1992) and law (1997) at the University of Western
Australia. Todd qualified as an Australian Patent
Attorney in 2000, having won the Institute Prize for
his performance in the qualifying examinations. Since
then, Todd’s practice has been dominated by small
molecule pharmaceutical patents, predominantly by
the collection of expert evidence for patent litigation.
