IP Australia is conducting a series of public consultations about the Australian patent system including whether to raise the bar for establishing an inventive step required for a patent. In this seminar, barrister Tom Cordiner talks about the current state of play of the debate and practical impacts of some of the detailed proposals. Associate Professor Beth Webster concludes with a discussion about the benefits of patent systems with high versus low inventive steps.
Tom Cordiner is an intellectual property and trade practices barrister of the Victorian Bar. He is also a registered Australian Patent Attorney and Trade Marks Attorney. He has both conducted, and been junior in, numerous trials and interlocutory disputes, predominantly in the Supreme and Federal Courts. Most recently he appeared in the special leave application to the High Court in UWA v Gray and, relevantly to this talk, has been involved in numerous patent infringement and revocation disputes. Tom is a member of the Licensing Executives' Society of Australia and New Zealand (LESANZ), the Intellectual Property Society of Australia and New Zealand (IPSANZ) and the Institute of Patent and Trade Mark Attorneys (IPTA). He also contributes quarterly to the law journal, IP Forum.
Beth Webster is an economist and Director of the Intellectual Property Research Institute of Australia (IPRIA) and Principal Research Fellow at the Melbourne Institute of Applied Economic and Social Research (University of Melbourne). Beth has undertaken wide-ranging research on the economics of innovation, intellectual property, as well as more general research on the performance of Australian enterprises. She has published widely including over 100 articles, books and reports. She is currently a member of the Advisory Council for Intellectual Property and has previously been a Commissioner for the Victorian State Services Authority and a member of the Bracks’ Review into the Automotive Industry.
